    Why is a Defendant Allowed to Have Somebody Examined?

    Generally speaking, the rules of procedure permit a defendant to obtain a medical examination of someone claiming the present effects of a personal injury because they have put their physical condition “in issue” under those circumstances. The defendant invariably hires a doctor to testify that the injury is either less severe than claimed, related to something other than the incident at issue, or totally nonexistent.     State of Georgia Rules that Caps on Pain and Suffering Damages in Malpractice Cases are Unconstitutional

    The highest court in the state of Georgia recently ruled that caps on noneconomic losses in medical malpractice cases are unconstitutional. Maryland has a cap on noneconomic damages. Noneconomic damages refers to pain and suffering. So, people who have the greatest pain and the greatest suffering are the individuals who are most denied fair and complete justice because they are entitled to the highest award for the pain and suffering they will frequently have for the rest of their lives. The highest court in Georgia found recently that this is fundamentally unfair. Every person, they declared, in all cases, is entitled to a jury determination of their damages. Let’s send a message to our legislators in Maryland to remove the cap on damages.

    117,000 Parking Tickets Dismissed From 2009

    In February 2009, the District of Columbia significantly increased the cost to park at its 15,453 parking meters and also  started charging for evening and Saturday parking.   Approximately 117,000 parking tickets (out of 200,000 issued) were dismissed in 2009 after the tickets were challenged in Court!

    The best defense to getting  a ticket is to “feed the meter”. If you do get a ticket, review it carefully. You may have grounds to get it dismissed.

    Common Causes of Motor Vehicle Collisions

    We read about the unfortunate loss of 16 year old Anthony Feather, from King George County, Virginia, who died on May 9, 2010 after being thrown from a motor vehicle.  Anthony and his friends went to their prom on Saturday night at King George High School.  While an investigation is still pending, it is believed that the driver was speeding when the vehicle left the road and struck a tree. 

    We continue to read about the increasing number of fatalities that occur as a result of motor vehicle collisions.   We must all take measures to ensure that we are safe on the road so that we do not injure ourselves, and more importantly, others on the roadway.

     The six most common causes of motor vehicle accidents are (as reported by Six.Wise.com):

    1)        Driver Distraction- Drivers are often distracted by using the cell phone,,  adjusting the radio, and reading while driving.

    2)        Driver Fatigue-   According to the U.S. National Highway Traffic Safety Administration, it has been reported that approximately 100,000 accidents are caused as a result of drowsy drivers.  Symptoms of driver fatigue include frequent yawning, and varing speed of the vehicle.

    3)        Drunk Driving-   According to the U.S. National Highway Traffic Safety Administration, approximately 16,654 people were killed in alcohol related crashes in 2004.

    4)        Speeding

    5)        Aggressive Driving-  Aggressive driving includes tailgating, disregarding traffic  signals, failing to yield right of way, and flashing lights

    6)        Weather

    Document and Understand the Impact of Your Bodily Injuries

     It is unfortunate when you become injured as a result of someone else’s carelessness.   It is also unfortunate that your daily routine is now altered due to doctor and physical therapy appointments.   However, even though it may be inconvenient and burdensome,  it is important that you seek proper medical treatment and follow through with your treatment plan.  

    Preliminarily, it is important to select a doctor that can treat your injuries.  When you meet with the doctor, you must first provide the doctor with a thorough history and advise the doctor of all bodily injuries (however minor the injury may be to you).   A history will allow the doctor to formulate a treatment plan and perform a proper evaluation and examination.   It is essential that you understand follow-through with the doctor’s treatment plan.   While you are undergoing treatment, you should document your injuries and pain level and record when the pain increases and/or decreases and what activities causes the pain to fluctuate.  This information will be helpful to your doctor with regard to further, if any, treatment that may be needed.

    The Advantages of Carrying UM and UIM Coverage
